Privacy Policy & Terms

Buying or selling a home means sharing a great deal about yourself. Sections 1 through 16 explain, in plain language, what information we collect at kmcoastal.com, why we collect it, who sees it, and the choices you have. Sections 17 through 28 are our terms of service — the rules for using this website.

1. Who we are

This website, kmcoastal.com, is operated by Kelli Miller, a Broker Associate licensed by the California Department of Real Estate (DRE #01840131) and affiliated with Compass, a real estate broker licensed by the State of California (DRE #01991628).

References to “we,” “us,” and “our” in this policy mean Kelli Miller and the KM Coastal team. This policy covers kmcoastal.com and the individual property landing pages we publish under it.

Compass maintains its own privacy practices governing the information it collects and processes as a brokerage. Where information is handled by Compass rather than by us, Compass’s privacy policy applies to that handling.

2. The information we collect

We collect only what we need to answer your questions and represent you well. In the past twelve months, we have collected the following categories of personal information:

  • Identifiers. Your name, email address, mailing address, phone number, and IP address.
  • Commercial and transaction information. Properties you asked about, showings you requested, your stated price range, timeline, and financing situation, and the general characteristics of a home you are looking for or selling.
  • Internet and device activity. Pages you viewed on our site, how long you stayed, links and photos you clicked, the site or ad that referred you, your browser type, device type, and approximate location inferred from your IP address.
  • Geolocation data. Approximate, city-level location derived from your IP address or from a map you interact with. We do not collect precise GPS location.
  • Audio and visual information. Voicemail messages you leave us, and, at some properties, footage recorded by a seller’s own security or doorbell cameras during a showing or open house.
  • Professional or financial context you volunteer. For example, telling us you are pre-approved with a particular lender, or that a purchase is contingent on another sale closing.
  • Inferences. Conclusions we reasonably draw from the above — such as which neighborhoods or price points are likely to interest you.

What we do not collect on this website. We do not ask for or store Social Security numbers, driver’s license numbers, bank account numbers, credit or debit card numbers, credit reports, or income documentation through kmcoastal.com. Documents like those are exchanged only through the secure transaction platforms used by Compass, your lender, escrow, and title — not through this site.

We also do not use this website to collect the categories California law defines as sensitive personal information, and we do not use or disclose sensitive personal information for purposes that would require us to offer a right to limit it.

3. Where that information comes from

  • Directly from you — contact and showing-request forms, emails, phone calls and texts, open house sign-in sheets, and conversations.
  • Automatically from your device — cookies, pixels, and similar technologies described in Section 5.
  • From advertising and social platforms — when you respond to an ad or message us through a platform such as Facebook, Instagram, or Google.
  • From real estate industry sources — the multiple listing service (MLS), Compass, referring agents, and lead sources such as Zillow or Realtor.com when you submit an inquiry through them.
  • From public records — county assessor, recorder, and other public property records used in market analysis and valuation.

4. How we use it

  • To respond to you — answering questions, scheduling showings, and sending property details you requested.
  • To provide real estate services — representing you in a purchase or sale, preparing market analyses, and coordinating with lenders, escrow, title, inspectors, and other agents on your transaction.
  • To send marketing you have asked for or would reasonably expect — new listings, open house announcements, market updates, and newsletters. You can opt out of any of it at any time.
  • To measure and improve our marketing — understanding which listings, ads, and pages generate interest, and reporting that performance to our sellers.
  • To improve this website — diagnosing problems, testing layouts, and making pages faster and easier to use.
  • To protect against fraud and misuse — identifying spam submissions, automated abuse, and security incidents.
  • To meet our legal obligations — California real estate license law, brokerage recordkeeping requirements, tax rules, and lawful requests from authorities.

We do not use your information to make decisions about you that produce legal or similarly significant effects without human involvement, and we do not engage in profiling beyond the ordinary marketing measurement described above.

5. Cookies, analytics, and advertising technologies

Our website and property landing pages use cookies and similar technologies. Some are necessary to make pages work. Others help us understand how the site is used, and some support advertising.

Google Analytics 4

We use Google Analytics to understand how visitors find and use our pages — which listings get attention, how far people scroll, and which sources send the most interested visitors. Google Analytics sets cookies and processes data on our behalf. You can opt out across all websites using Google’s browser add-on.

Google Tag Manager and Google Ads

We use Google Tag Manager to manage these tags, and we may run Google Ads campaigns that use conversion tracking and remarketing. You can control how Google personalizes ads to you through Google My Ad Center.

Meta Pixel

We use the Meta Pixel on our listing pages so we can show relevant listings to people who have visited them, and so we can measure whether our Facebook and Instagram advertising is working. The pixel tells Meta that a browser visited a page and, when you submit a form, that a lead event occurred. You can manage this through your Facebook ad preferences.

Your browser controls

Most browsers let you refuse or delete cookies. Blocking cookies will not prevent you from using this site, though some conveniences may stop working. We honor the Global Privacy Control (GPC) signal — see Section 10.

6. Calls, texts, and SMS terms

Real estate moves quickly, and most of our clients prefer a text to a phone call. Here is exactly what you are agreeing to.

What consent you are giving

When you check the consent box on a form on this website, or give us your phone number at an open house or by text, you consent to be contacted at that number by Coastal Collective Real Estate — the team of Kelli Miller, Broker Associate at Compass, also referred to on this site as KM Coastal — by phone call, text message, and email, about your inquiry and about real estate services, including messages sent using automated dialing or texting technology. Consent is not a condition of buying or selling a home, or of any purchase. Message and data rates may apply, and message frequency varies. You must be at least eighteen years old to give consent.

Our text message (SMS) program

We operate a text messaging program for people who ask to hear from us. These are its terms.

We do not share your mobile information

Text messaging originator opt-in data and consent are not shared with any third parties. No mobile information — including your phone number, your opt-in to receive text messages, and your consent to be contacted — will be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

This restriction applies to every category of information described in Section 7 of this policy: all of those categories exclude text messaging originator opt-in data and consent. The only parties that ever handle your mobile opt-in data are the service providers that deliver messages on our behalf, and they are contractually prohibited from using it for any other purpose.

How to stop

  • Texts: reply STOP to any message to end them, or HELP for help. We will send one confirmation and then stop.
  • Email: use the unsubscribe link at the bottom of any marketing email, or reply asking to be removed.
  • Calls: tell us on the call, or email or text us, and we will add you to our internal do-not-call list.

We maintain an internal do-not-call list and honor requests promptly. If you have an active transaction with us, we may still need to contact you about that transaction after you opt out of marketing.

7. How we share information

We have never sold personal information for money, and we will not. We do not sell your information to data brokers or lead resellers.

We do share information in the following ways:

  • With Compass — our brokerage, which maintains transaction records as required by California law.
  • With transaction participants — when you are actively buying or selling, with the other side’s agent, escrow, title, lenders, inspectors, appraisers, transaction coordinators, photographers, stagers, and contractors, as needed to complete your transaction.
  • With service providers — email and CRM platforms, website hosting, form processing, e-signature services, and analytics vendors that process information on our behalf under contracts limiting what they may do with it.
  • With advertising platforms — Meta and Google receive online identifiers and browsing activity through the pixels described in Section 5. Under California law this is considered “sharing” for cross-context behavioral advertising, even though no money changes hands. You can opt out in Section 10.
  • With the MLS and syndication partners — listing information about a property we represent, which is distributed publicly to consumer real estate websites.
  • When the law requires it — subpoenas, court orders, regulatory requests, or to protect the safety, rights, or property of any person.
  • In a business transfer — if our practice merges with or is acquired by another brokerage or team, client records may transfer as part of that change.

The categories of personal information we have shared for cross-context behavioral advertising in the past twelve months are identifiers and internet or other electronic network activity information. We do not knowingly sell or share the personal information of anyone under sixteen.

All of the categories above exclude text messaging originator opt-in data and consent. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Your phone number and your text messaging consent are never sold, rented, or passed to advertising platforms, lead resellers, data brokers, or affiliates — only to the service providers that deliver our messages, under contracts that prohibit any other use. See Section 6.

8. How long we keep it

  • Inquiries that do not become transactions — kept while you remain interested in hearing from us, and deleted on request.
  • Client and transaction records — retained by our brokerage for at least three years after the closing or termination of the transaction, as California real estate law requires, and often longer where tax or legal obligations apply.
  • Marketing lists — kept until you unsubscribe, plus a permanent suppression entry so we do not accidentally contact you again.
  • Website analytics — retained according to the settings of the platforms described in Section 5, generally no longer than fourteen months in an identifiable form.

When we no longer need information for these purposes, we delete it or de-identify it.

9. Your California privacy rights

California residents have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act.

Right to know

Ask what personal information we have collected about you, where it came from, why we collected it, and who we disclosed it to.

Right to delete

Ask us to delete the personal information we hold about you, subject to legal recordkeeping exceptions.

Right to correct

Ask us to fix personal information about you that is inaccurate.

Right to opt out

Direct us to stop sharing your information for cross-context behavioral advertising. See Section 10.

Right to limit

Restrict our use of sensitive personal information. We do not use it in ways that trigger this right.

Right to non-discrimination

We will never deny you service, charge you differently, or give you a lesser experience for exercising any of these rights.

How to make a request

Use either of these two methods:

How we verify you

To protect your information, we confirm you are who you say you are before acting on a request to know, delete, or correct. Usually this means matching the email address or phone number in your request against what we already have on file, and sometimes asking you to confirm a detail only you would know — such as the property you inquired about. We will not ask you for sensitive documentation to verify a request.

We will confirm receipt within ten business days and respond substantively within forty-five calendar days. If we need more time, we will tell you why and take no more than an additional forty-five days.

Authorized agents

You may use an authorized agent to submit a request on your behalf. We will ask the agent for written permission signed by you, and we may ask you to verify your own identity directly with us and to confirm that you granted the agent permission. An agent holding a valid power of attorney under California Probate Code sections 4000 to 4465 does not need to provide separate written permission.

10. Do not sell or share my personal information

We do not sell personal information. We do share online identifiers and browsing activity with Meta and Google for advertising, as described in Section 7. You have three ways to stop that.

Your phone number and your text messaging consent are not part of that sharing. Mobile opt-in data is never shared with third parties or affiliates for marketing purposes, regardless of the setting you choose below.

Option one — opt out on this site

Use the button below. It records your choice in this browser and prevents our advertising pixels from loading on our pages going forward. Because the setting lives in your browser, you will need to repeat it on each browser and device you use, and it will be cleared if you clear your site data.

Option two — Global Privacy Control

We recognize and honor the Global Privacy Control signal. If your browser or extension sends GPC, we treat it as a valid opt-out request for that browser automatically, with nothing further required from you.

Option three — tell us directly

Email kelli.miller@compass.com or call 858.784.1674 and ask us to opt you out. We will also apply it to your record in our systems, which a browser setting cannot do.

12. How we protect information

We use reasonable security measures appropriate to the sensitivity of what we hold: encrypted connections on this website, access controls and multi-factor authentication on the accounts that store client information, reputable vendors for email and file storage, and a practice of not collecting financial or identity documents through this website at all.

No method of transmitting or storing information is perfectly secure, and we cannot guarantee absolute security. Please do not send Social Security numbers, account numbers, or images of identity documents by ordinary email or through a website form — ask us for a secure link instead.

13. Children’s privacy

This website is intended for adults engaged in real estate transactions. We do not knowingly collect personal information from anyone under sixteen, and we do not sell or share the personal information of anyone under sixteen. If you believe a child has provided us information, contact us and we will delete it.

14. Fair housing and equal opportunity

We are committed to the letter and the spirit of federal and California fair housing law. We do not ask about, record, or use race, color, religion, national origin, sex, gender identity, sexual orientation, marital status, familial status, disability, source of income, or any other protected characteristic to target advertising, screen inquiries, steer clients toward or away from neighborhoods, or make any decision about who we represent.

Compass is a real estate broker licensed by the State of California and abides by Equal Housing Opportunity laws.

15. Changes to this policy

We review this policy at least once every twelve months and update it whenever our practices change. The effective date and last-updated date at the top of this page always reflect the current version. Material changes will be noted prominently on this page. Continuing to use kmcoastal.com after a change means you accept the updated policy.

17. Terms of service

The sections that follow are the terms of service for kmcoastal.com. They govern your use of this website and of the text messaging, email, and calling program described in Section 6.

By using this website, submitting a form, or agreeing to be contacted by us, you accept these terms and the privacy practices described in Sections 1 through 16. If you do not accept them, please do not use the site.

This site is operated by Coastal Collective Real Estate — the team of Kelli Miller, Broker Associate at Compass, DRE #01840131, also referred to on this site as KM Coastal. Compass is a real estate broker licensed by the State of California, DRE #01991628.

18. What this website is, and what it is not

  • It is marketing and information. Content here describes properties, neighborhoods, market conditions, and our services.
  • It is not advice. Nothing on this site is legal, tax, accounting, financial, appraisal, engineering, or construction advice. Consult a qualified professional before acting on anything you read here.
  • It is not an offer. Listing information, pricing, and availability are subject to change or withdrawal without notice, and nothing here constitutes an offer to sell or a solicitation of an offer to buy real property.
  • It does not create a working relationship. Browsing the site, submitting a form, or exchanging messages with us does not by itself create an agency, brokerage, or fiduciary relationship. That relationship begins only when a written representation agreement is signed by both of us.
  • It is not confidential. Do not send confidential, privileged, or sensitive documents through a website form or ordinary email. Ask us for a secure link instead.

19. Property information, MLS data, and valuations

Property details on this site come in part from the multiple listing service, public records, and third-party data providers. That information is deemed reliable but is not guaranteed, and it should be independently verified. Square footage, lot size, permits, bedroom and bathroom counts, school assignments, HOA figures, and tax amounts are frequently inaccurate in source data.

Any home valuation, estimate, or market analysis produced through this site or by our team is an opinion of value, not an appraisal. It is not a guarantee of sale price, and it may not be used in place of a licensed appraisal for lending or legal purposes.

MLS data is governed by the rules of the MLS that publishes it. All properties are subject to prior sale, change, or withdrawal.

20. Electronic communications and text messaging

You agree that we may communicate with you electronically, and that electronic communications satisfy any legal requirement that a communication be in writing. Section 6 sets out the full terms of our text messaging program. In summary:

  • Messages are sent by Coastal Collective Real Estate, the team of Kelli Miller at Compass.
  • You opt in by checking the consent box on a form, giving us your number in person or in writing, or by texting us first. Consent is not a condition of purchase or of any real estate service.
  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to opt out at any time, or HELP for assistance.
  • Carriers are not liable for delayed or undelivered messages.
  • You must be at least eighteen years old, and you must be the account holder of the mobile number you give us or have the account holder’s permission.
  • Tell us promptly if your mobile number changes or is reassigned, so that messages intended for you do not reach someone else.
  • Text messaging originator opt-in data and consent are not shared with any third parties for marketing or promotional purposes, as described in Sections 6, 7, and 10.

21. Intellectual property

The text, photography, video, floor plans, drone footage, layouts, and design of this website are owned by us or licensed to us, and are protected by copyright and trademark law. Listing photography is generally licensed to us for the marketing of a specific property and may not be reused elsewhere.

You may view, print, and share individual pages for your own personal, non-commercial use. You may not copy, republish, scrape, frame, or use any content for another agent’s or company’s marketing without our written permission. Compass names and logos are the property of Compass and used under its brand rules.

22. Acceptable use

When you use this site, you agree not to:

  • Submit false, misleading, or impersonated information, or a phone number you are not authorized to give us.
  • Use automated tools to scrape, harvest, index, or bulk-download content, listing data, or contact information.
  • Attempt to gain unauthorized access to the site, its hosting, its forms, or any connected system, or to probe or test its security.
  • Introduce malware, submit spam, or overload the site or its forms.
  • Use the site or any information from it to violate fair housing law, to discriminate, or to harass anyone.
  • Use our content or contact information for unsolicited commercial recruiting or solicitation of our clients.

We may block access, remove content, or decline to respond to inquiries that violate these rules.

23. Copyright complaints

If you believe content on this site infringes your copyright, send a written notice to kelli.miller@compass.com with the subject line “Copyright Notice.” Include a description of the work, the URL where it appears, your contact information, a statement that you believe the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your signature.

We investigate valid notices promptly and remove or disable infringing material where appropriate. We also terminate access for repeat infringers.

24. Third-party links and services

This site links to and embeds services we do not control, including Google Maps, YouTube, Compass listing pages, mortgage calculators, and consumer real estate portals. We do not endorse and are not responsible for their content, availability, accuracy, or privacy practices, and your use of them is governed by their own terms.

Mentions of lenders, escrow and title companies, inspectors, contractors, or stagers are referrals for your convenience. You are free to choose any provider, and we do not guarantee anyone’s work.

25. Disclaimers and limitation of liability

This website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that the site will be free of viruses or other harmful components.

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits or lost opportunities, arising out of your use of this website or your reliance on information found here. Our total liability arising from the website is limited to one hundred dollars.

Nothing in this section limits any obligation we owe you under a signed representation agreement, under California real estate license law, or under any liability that cannot lawfully be limited.

26. Indemnification

You agree to indemnify and hold harmless Kelli Miller, the KM Coastal and Coastal Collective Real Estate team, and Compass from claims, damages, and reasonable legal fees arising out of your misuse of this website, your violation of these terms, or your violation of the rights of any third party.

27. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising from this website or these terms will be brought in the state or federal courts located in San Diego County, California, and you consent to that jurisdiction and venue.

Before filing anything, please contact us. Most disagreements are resolved in a phone call. This section does not affect any dispute resolution or arbitration provision contained in a separate signed agreement between us, including a Compass representation agreement, which controls over this section for matters within its scope.

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.

28. Changes to these terms

We may update these terms as our practices, our tools, or the law change. The last-updated date at the top of this page reflects the current version, and continuing to use kmcoastal.com after a change means you accept the updated terms.
